Talvez a mais aceita seja a que atribui sua criação a Donato "Duke" Antone que era o proprietário do Duke's Backwatch Bar em Hollywood. Foi ali, no Sunset Boulevard, em 1952, que Antone teria criado o coquetel, dando o nome de um surfista local, frequentador regular do bar, chamado Tom Harvey.

4 blackberries, divided
1 1/2 oz. vodka
3/4 oz. Byrrh
3/4 oz. lemon juice
1/2 oz. simple syrup
Muddle 4 mint leaves and 3 blackberries, then add mixture to a cocktail shaker, along with vodka, byrrh, lemon juice, and simple syrup. Shake and strain into a tall glass filled with ice.Top with club soda and garnish with remaining blackberry and mint leaf.
